We strongly advise you to review the terms and policies of any external websites you visit.

• Termination: We reserve the right to terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including any breach of these Terms. All provisions of the Terms that should logically survive termination will remain in effect.

2. Service & Product Policies
 

• Orders: Placing an order with Poison Ivy Couture constitutes your full acceptance of these Terms, including our specific ordering and return policies. Refusal to agree to these terms may result in the cancellation of your order.

• Sizing & Product Details: It is your responsibility to check the sizing charts and product descriptions provided on our website before placing an order. We do not offer refunds or exchanges for incorrect sizing choices made by the customer.

• Returns & Exchanges: All sales are final. We do not offer refunds or exchanges under any circumstances, except for a faulty or damaged product as required by law.

• Shipping & Handling: We aim for fair and transparent pricing. Please note that prices reflect not only the product cost but also associated expenses like packaging and handling. We are not responsible for delays or issues with delivery once the item has been handed over to the shipping carrier.

• Inappropriate Conduct: If a customer engages in threatening, harassing, or otherwise inappropriate behavior, Poison Ivy Couture reserves the right to cancel the order with immediate effect and without a refund, and may refuse future service.

• Poison Ivy Couture® is a registered trademark (Registration No. 2091528) under the Trade Marks Act 1995 (Cth). Our rights extend to Class 25 (Clothing, footwear, headgear) and our established reputation in jewelry, homewares, and beauty. Any unauthorized use of the name "Poison Ivy Couture," "Poison Ivy," or our signature logos in a deceptively similar manner within the fashion and lifestyle retail sector is strictly prohibited and will be met with legal action.

• 2. Heritage & Copyright

• Established over 30 years ago, Poison Ivy Couture has built a unique aesthetic documented through decades of creative work, including historical contributions to BeWitchy magazine. All original designs, custom patterns, photography, and text on this website are the intellectual property of Poison Ivy Couture.
   

• Visual Rights & Product Imagery: All original designs, custom patterns, and curated imagery (including original photography and digitally rendered assets) on this website are the exclusive intellectual property of Poison Ivy Couture. We do not permit the use of our visual assets for:

• Third-party commercial listings or deceptive hire services.

• The training of Artificial Intelligence (AI) models or external generative tools.

• Social media accounts not officially affiliated with our brand.

• Any unauthorized reproduction, scraping, or "borrowing" of our visual assets is a violation of Australian Copyright law and will be pursued.
   

• 3. Poison Ivy: Re-Vamped (The Heritage Collection)

• We are proud to present Poison Ivy: Re-Vamped, our curated selection of second-hand, vintage, and archive apparel. By purchasing from this collection, you agree to the following terms:

• Authenticity: We take every effort to verify the brands we resell. Poison Ivy Couture is not an authorized dealer for third-party brands unless explicitly stated.

• Condition & Grading: All "Re-Vamped" items are sold "as-is." We provide detailed descriptions and photography of any wear or tear. By purchasing, you acknowledge the unique, pre-owned nature of these pieces.

• Sustainability: This initiative is part of our commitment to circular fashion—keeping alternative style in circulation and reducing textile waste.

• Returns: Due to the unique nature of second-hand items, all sales in the "Re-Vamped" collection are final unless an item is found to be significantly different from its description.

• 4. Brand Protection & Passing Off

• We actively monitor the market to protect our community from "copy-cat" brands and deceptive hire services. Our legacy is built on original couture. Using our name or a deceptively similar name to offer services within the clothing industry constitutes "passing off" and trademark infringement, which we defend vigorously to maintain the exclusivity and integrity of the Poison Ivy Couture name.
